Mediation is a process by which a certified mediator considers the facts of a dispute and determines what is intended to be a fair outcome. Because the mediator is often an attorney, both parties can save money on attorney fees. Because mediations are generally quicker than court battles, they also save time.
Most importantly, however, each party's relevant concerns are sorted out by an impartial professional who comes to a non-binding decision. This means that you and your spouse will retain control of the situation. You can choose to abide by the terms of the decision, or to reject it. If you choose the latter, you will still have a foundation on which to build subsequent negotiations. You will also retain your option to pursue a divorce action in court.
